(www.vknews.in) ಕರ್ನಾಟಕ ರಾಜ್ಯ ಶಾಲಾಭಿವೃದ್ಧಿ ಮತ್ತು ಮೇಲುಸ್ತುವಾರಿ ಸಮಿತಿಗಳ ಸಮನ್ವಯ ವೇದಿಕೆಯು ಮಾನ್ಯ ಮುಖ್ಯ ಮಂತ್ರಿಗಳಿಗೆ ಶಿಕ್ಷಣ ಇಲಾಖೆ ದಿನಾಂಕ 19.10.2022 ರಂದು ಹೊರಡಿಸಿರುವ ಆದೇಶ ಸಂವಿಧಾನದ ಪರಿಚ್ಛೇಧ 21 ಎ ಮತ್ತು ಉಚಿತ ಮತ್ತು ಕಡ್ಡಾಯ ಶಿಕ್ಷಣಕ್ಕಾಗಿ ಮಕ್ಕಳ ಹಕ್ಕು ಕಾಯಿದೆ 2009 ರ ಸ್ಪಷ್ಟ ಉಲ್ಲಂಘನೆ ಯಾಗಿರುವ ಬಗ್ಗೆ ಬಹಿರಂಗ ಪತ್ರವನ್ನು ಬರೆದಿದೆ
ಶಿಕ್ಷಣ ಇಲಾಖೆ ಎಲ್ಲಾ ಮಕ್ಕಳಿಗೆ ಗುಣಾತ್ಮಕ ಶಿಕ್ಷಣ ಒದಗಿಸಲು ಸಂಪೂರ್ಣವಾಗಿ ಸೋತಿದ್ದು, ಪ್ರತಿನಿತ್ಯ ಒಂದಲ್ಲ ಒಂದು ಗೊಂದಲವನ್ನು ಸೃಷ್ಟಿಸಿ ಸುದ್ದಿ ಮಾಡುತ್ತಿದೆ. ಕಳೆದ ಎರಡು ಮೂರು ವರ್ಷಗಳಿಂದ ಶಾಲಾ ಶಿಕ್ಷಣ ಹಾಗು ಸಾಕ್ಷರತಾ ಸಚಿವರು ಶಿಕ್ಷಣ ಇಲಾಖೆ ಸಾರಥ್ಯ ವಹಿಸಿಕೊಂಡ ನಂತರ, ಹಕ್ಕು ಆಧಾರಿತ ನೆಲೆಯಲ್ಲಿ ಕಾರ್ಯಕ್ರಮಗಳನ್ನು ರೂಪಿಸಿ ಎಲ್ಲಾ ಮಕ್ಕಳಿಗೆ ಗುಣಾತ್ಮಕ ಶಿಕ್ಷಣ ಒದಗಿಸುವ ಬದಲು , ಸ್ವಲ್ಪ ಮಟ್ಟಿಗಾದರೂ ಪ್ರಗತಿಪರ ನೆಲೆಯಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿದ್ದ ರಾಜ್ಯ ಶಿಕ್ಷಣ ವ್ಯವಸ್ಥೆಯನ್ನು ಧರ್ಮ ಹಾಗು ಅವೈಜ್ಞಾನಿಕ ನೆಲೆಯಲ್ಲಿ ಹಾಳುಗೆಡವಿದ್ದಾರೆ .
ಸಚಿವರು ಶಿಕ್ಷಣ ಒಂದು ಸಾಮಾಜಿಕ ಒಳಿತು ಹಾಗು ಶಿಕ್ಷಣ ಹಕ್ಕು ಕಾಯಿದೆ ಅನ್ವಯ ಅದೊಂದು ಮೂಲಭೂತ ಹಕ್ಕೆಂದು ತಿಳಿದು ಅದನ್ನು ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಜಾರಿಗೊಳಿಸಲು ಪೂರ್ಣವಾಗಿ ಸೋತಿದ್ದಾರೆ . ಹೀಗಾಗಿ , ಕರ್ನಾಟಕದಲ್ಲಿ ಶಾಲಾ ಶಿಕ್ಷಣ ಗೊಂದಲಮಯವಾಗಿದ್ದು , ವ್ಯವಸ್ಥೆ ಪೂರ್ಣವಾಗಿ ಹಳಿತಪ್ಪಿದೆ.
ಇದಕ್ಕೆ ಸಾಕ್ಷಿಯಾಗಿ ,ಶಿಕ್ಷಣ ಇಲಾಖೆ ದಿನಾಂಕ 19.10.2022 ರಂದು ಹೊರಡಿಸಿರುವ ಆದೇಶ ಸಂಖ್ಯೆ : ಸಿ 7 (1) ಸ . ಶಾಲಾ. ದೇಣಿಗೆ.1/ 2022-23 ಆದೇಶವು ವಿಶ್ವ ಸಂಸ್ಥೆಯ ಮಕ್ಕಳ ಹಕ್ಕುಗಳ ಒಡಂಬಡಿಕೆ ಪರಿಚ್ಛೇಧ28 ಹಾಗು29 , ಸಂವಿಧಾನದ ಪರಿಚ್ಛೇಧ21 ಎ ,39 ಇ ಹಾಗು ಎಫ್ , 41 , 46 ಮತ್ತು ಶಿಕ್ಷಣ ಹಕ್ಕು ಕಾಯಿದೆ ಪ್ರಕರಣ 3, 7, 8 , 9, 18 ,19 ಮತ್ತು 29 ರ ಸ್ಪಷ್ಟ ಉಲ್ಲಂಘನೆಯಾಗಿದೆ .
ಇದನ್ನು ವಿಸ್ತರಿಸಿ ಹೇಳಬೇಕೆಂದರೆ , ವಿಶ್ವ ಸಂಸ್ಥೆಯ ಮಕ್ಕಳ ಹಕ್ಕುಗಳ ಒಡಂಬಡಿಕೆ ಪರಿಚ್ಛೇಧ28 ರ ಅನ್ವಯ:
1. States Parties recognize the right of the child to education, and with a view to achieving this right progressively and on the basis of equal opportunity, they shall, in particular: (a) Make primary education compulsory and available free to all;
ಸಂವಿಧಾನದ ಪರಿಚ್ಛೇಧ 21 ಎ ಅನ್ವಯ :
The State shall provide free and compulsory education to all children of the age of six to fourteen years in such manner as the State may, by law, determine. [86th Constitutional Amendment 2002]
ಉಚಿತ ಮತ್ತು ಕಡ್ಡಾಯ ಶಿಕ್ಷಣ ಹಕ್ಕು ಕಾಯಿದೆ ಪ್ರಕರಣ 3,7 ಮತ್ತು 8 ರ ಅನ್ವಯ
3. Right of child to free and compulsory Education :
1[(1) Every child of the age of six to fourteen years, including a child referred to in clause (d) or clause (e) of section 2, shall have the right to free and compulsory education in a neighbourhood school till the completion of his or her elementary education.]
(2) For the purpose of sub-section (1), no child shall be liable to pay any kind of fee or charges or expenses which may prevent him or her from pursuing and completing the elementary education.
Section -7
7. Sharing of financial and other responsibilities.—(1) The Central Government and the State Governments shall have concurrent responsibility for providing funds for carrying out the provisions of this Act.
(2) The Central Government shall prepare the estimates of capital and recurring expenditure for the implementation of the provisions of the Act.
(3) The Central Government shall provide to the State Governments, as grants-in-aid of revenues, such percentage of expenditure referred to in sub-section (2) as it may determine, from time to time, in consultation with the State Governments.
(4) The Central Government may make a request to the President to make a reference to the Finance Commission under sub-clause (d) of clause (3) of article 280 to examine the need for additional resources to be provided to any State Government so that the said State Government may provide its share of funds for carrying out the provisions of the Act.
(5) Notwithstanding anything contained in sub-section (4), the State Government shall, taking into consideration the sums provided by the Central Government to a State Government under sub-section (3), and its other resources, be responsible to provide funds for implementation of the provisions of the Act.
Section -8
Duties of appropriate Government.—The appropriate Government shall— (a) provide free and compulsory elementary education to every child:
Explanation.—The term “compulsory education” means obligation of the appropriate
Government to— (i) provide free elementary education to every child of the age of six to fourteen years; and (ii) ensure compulsory admission, attendance and completion of elementary education by every child of the age of six to fourteen years; (b) ensure availability of a neighbourhood school as specified in section 6; (c) ensure that the child belonging to weaker section and the child belonging to disadvantaged group are not discriminated against and prevented from pursuing and completing elementary education on any grounds; (d) provide infrastructure including school building, teaching staff and learning equipment; (e) provide special training facility specified in section 4; (f) ensure and monitor admission, attendance and completion of elementary education by every child; (g) ensure good quality elementary education conforming to the standards and norms specified in the Schedule; (h) ensure timely prescribing of curriculum and courses of study for elementary education; and (i) provide training facility for teachers.
ಮೇಲೆ ತಿಳಿಸಿದಂತೆ ಉಚಿತ ಮತ್ತು ಕಡ್ಡಾಯ ಗುಣಾತ್ಮಕ ಶಿಕ್ಷಣ ಒದಗಿಸುವ ಪೂರ್ಣ ಜವಾಬ್ದಾರಿ ಸರಕಾರದ ಮೇಲಿರುವಾಗ , ಅದನ್ನು ಬಡ ಪಾಲಕರ ಹೆಗಲಿಗೆ ವರ್ಗಾಯಿಸುವುದು ಅಂತಾರಾಷ್ಟ್ರೀಯ ಕಾನೂನು , ಸಂವಿಧಾನ ಮತ್ತು ಶಿಕ್ಷಣ ಹಕ್ಕು ಕಾಯಿದೆಯ ಸ್ಪಷ್ಟ ಉಲ್ಲಂಘನೆಯಾಗಿದೆ.
ಇದೆಲ್ಲವನ್ನು ಸೂಕ್ಷವಾಗಿ ಗಮನಿಸಿದರೆ , ಶಿಕ್ಷಣ ಸಚಿವರಾದ ಸನ್ಮಾನ್ಯ ನಾಗೇಶ್ ರವರು ತಮ್ಮ ಸಂವಿಧಾನಾತ್ಮಕ ಹಾಗು ನೆಲದ ಕಾನೂನುಗಳ ಅಡಿಯಲ್ಲಿ ಕಾರ್ಯನಿರ್ವಹಿಸಲು ಸಂಪೂರ್ಣ ವಿಫಲರಾಗಿದ್ದು ಅವರನ್ನು ಕೂಡಲೇ ಸಚಿವ ಸ್ಥಾನದಿಂದ ಬಿಡುಗಡೆಗೊಳಿಸಬೇಕೆಂದು ಸಮನ್ವಯ ವೇದಿಕೆ ಒತ್ತಾಯಿಸುತ್ತದೆ.
ಇಂತಹ ಅವೈಜ್ಞಾನಿಕ ನಿರ್ಧಾರದಿಂದ ಶಿಕ್ಷಣ ಹಕ್ಕು ಕಾಯಿದೆಯು ನಿರಂತರ ಉಲ್ಲಂಘನೆಯಾಗುತ್ತಿದ್ದು, ತಾವು ದಯಮಾಡಿ ಮಧ್ಯ ಪ್ರವೇಶಿಸಿ ಮೇಲಿನ ಸುತ್ತೋಲೆಯನ್ನು ಕೂಡಲೇ ಹಿಂದಕ್ಕೆ ಪಡೆಯಬೇಕೆಂದು ಕರ್ನಾಟಕ ರಾಜ್ಯ ಶಾಲಾ ಅಭಿವೃದ್ಧಿ ಮತ್ತು ಮೇಲುಸ್ತುವಾರಿ ಸಮಿತಿಗಳ ಸಮನ್ವಯ ವೇದಿಕೆ ಪರವಾಗಿ ಒತ್ತಾಯಿಸುತ್ತೇನೆ.
